TERMS OF USE

These Terms of Use apply to panup.tv, run by Pan Up Productions ("Pan Up," "we," "us"). By using the site, you agree to these terms. If you don't agree, please don't use the site.

1. OUR CONTENT

The films, commercials, photography, text, graphics, logos and design on this site belong to Pan Up Productions, our directors and photographers, and/or our clients. They are protected by copyright, trademark and other laws. Unless we say otherwise, we and our collaborators keep all rights.

2. CLIENT BRANDS

Client names, logos and trademarks shown on this site belong to their owners. They appear only to identify work we produced or contributed to. Showing them does not mean those brands endorse or sponsor Pan Up or anyone else, and you may not use them.

3. HOW YOU MAY USE THE SITE

You may view the site for your own personal or internal business use, such as reviewing our work or considering us for a project. Without our written permission, you may not:

  • Download, copy, reproduce, edit, distribute, or publicly display any content from the site

  • Use site content to train, fine-tune, or prompt AI or machine-learning tools

  • Scrape, crawl, or harvest the site or its content with automated tools

  • Frame or mirror the site, or present our work as your own

  • Interfere with the site's security or operation, or use it for anything unlawful

4. THIRD-PARTY SERVICES AND LINKS

Videos on the site are hosted and played by Vimeo, and the site is hosted by Squarespace. The site may link to other websites, such as press coverage, festivals and social media. These services are run by third parties under their own terms and privacy policies, and we're not responsible for their content or practices.

5. IDEAS AND SUBMISSIONS

If you send us scripts, treatments, pitches, or other ideas, you agree that we are not obligated to keep them confidential, review them, return them, or pay for them, unless we have a separate written agreement with you. Pan Up and our collaborators may already be developing similar material on their own.

6. COPYRIGHT CONCERNS

If you believe something on this site infringes your copyright, email info@panup.tv. Include the work, where it appears on the site, and your contact information, and we'll look into it promptly.

7. DISCLAIMER

The site and its content are provided "as is" and "as available," without warranties of any kind, express or implied. We don't guarantee that the site will be accurate, complete, uninterrupted, or free of errors or harmful components.

8. LIMITATION OF LIABILITY

To the fullest extent allowed by law, Pan Up Productions and its members, employees and collaborators are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the site. Our total liability for any claim related to the site will not exceed $100.

9. INDEMNITY

You agree to indemnify and hold Pan Up harmless from claims, losses and expenses, including reasonable attorneys' fees, that arise from your misuse of the site or your violation of these terms.

10. GOVERNING LAW

These terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute about the site will be heard only in the state or federal courts located in New York City, and you consent to their jurisdiction.

11. CHANGES

We may update these terms from time to time. Changes take effect when posted, and the effective date above will show when they were last updated. If you keep using the site after a change, you accept the updated terms.

12. GENERAL

If any part of these terms is found unenforceable, the rest stays in effect. If we don't enforce a provision, that doesn't waive our right to enforce it later. These terms, together with our Privacy Policy, are the entire agreement between you and Pan Up about the site. Any separate written agreement for a production, license, or project controls over these terms.
